Resumo O surgimento da expressão Sistema Penitenciário se deu no século XIX, a partir da prisão perpétua, pena esta substitutiva da pena de morte. Nessa época pretendiam que a prisão tivesse condições de reabilitar o indivíduo. No Direito Penal Moderno, a pena tem caráter retributivo e preventivo objetivando a reintegração do infrator à sociedade. O processo de ressocialização corresponde a uma nova assimilação dos padrões comportamentais e valorativos da sociedade pelo indivíduo que os infringiu. A partir do momento em que o indivíduo não consegue atender satisfatoriamente as suas necessidades ele passa aos poucos a ser excluído da sociedade. Para reverter esse processo de exclusão faz-se necessário a participação e colaboração da sociedade, pois a ressocialização é trabalho que deve ser realizado em conjunto pelo Sistema Penitenciário e essa mesma sociedade. Este estudo tem por finalidade demonstrar que as políticas sociais aplicadas à privação da liberdade não é medida dotada de eficácia no controle ao combate a criminalidade. Assim como o encarceramento da forma como atualmente é feito não funciona como medida de ressocialização dos reclusos nos sistemas prisionais. Os métodos de pesquisas utilizados neste trabalho foram o histórico, comparativo aplicados com a técnica documental proveniente de fontes primárias como legislação, estatísticas oficiais e fontes secundárias como livros e acesso a Banco de Dados como a internet. Chegando a conclusão de que as atuais politicas carcerárias adotadas não visam à recuperação do indivíduo infrator, tão somente a sua exclusão da vida em sociedade.

Abstract The sprouting of the expression Penitentiary System if gave in century XIX, from the life imprisonment, penalty this substitute of the death penalty; at this time they intended that the arrest had conditions to rehabilitate the individual. In the Modern Criminal law, the penalty has retributivo and preventive character objectifying the reintegration of the infractor to the society. The ressocialization process corresponds to a new assimilation of the mannering and valorative standards of the society, for the individual that infringed them. From the moment where the individual does not obtain to take care of its necessities satisfactorily it passes to the few to be excluded from the society. To revert this process of exclusion one becomes necessary the participation and contribution of the society, therefore the ressocialization is work that must be carried through in set for the Penitentiary System and this same society. This study aims to demonstrate that social politics applied to the deprivation of liberty is endowed measure of effectiveness in combating crime control. Just as incarceration of the way does not work is currently done as a measure of rehabilitation of inmates in prison systems.The methods of research used in this work had been the description, comparative applied with the documentary technique proceeding from primary sources as official legislation, statisticians and secondary sources as books and access the Data base as the Internet. Reaching the conclusion that the current prison policies adopted not seek the recovery of the individual offender, so only their exclusion from social life.
