Resumo A presente pesquisa inicia-se pela evolução histórica da pena de prisão, passando pela antiguidade, idade média, moderna e o período humanitário, marcado pelos grandes pensadores Cesare Beccaria, John Howard e Jeremy Bentham. Em seguida há uma exposição das teorias que fundamentam os objetivos das penas. Desta forma foram citadas as seguintes teorias: Retributiva; Relativa que consiste na Prevenção Geral e Especial; Teoria mista tendo Claus Roxin como expoente e por último a teoria da doutrina contemporânea. Nesta linha de raciocínio, procede-se a incursão do modelo do sistema penitenciário brasileiro, os tipos de penas privativas de liberdade e os modelos de regimes prisionais. Destacam-se também alguns fatores que expõem a falência da pena privativa de liberdade que são demonstradas pelo crescimento de crimes, rebeliões e fugas que denigrem a capacidade administrativa do Estado.

Abstract This research begins with the historical evolution of imprisonment, through ancient, middle ages, modern and humanitarian period marked by great thinkers Cesare Beccaria, Jeremy Bentham and John Howard. Then there is an exhibition of the theories that underlie the goals of feathers. , Relative consisting of the General and Special Prevention; Theory mixed with Claus Roxin as exponent and finally the theory of contemporary retributive doctrine: in this way the following theories were cited. This line of reasoning, proceeds to raid the model of the Brazilian prison system, the types of custodial sentences and models of prison regimes, highlighting an attention to different disciplinary regime. We also highlight some factors that expose the bankruptcy of deprivation of liberty that are demonstrated by the growth of crime, riots and escapes that denigrate the administrative capacity of the state.
