Resumo O presente artigo objetiva analisar a interferência do Poder Judiciário na efetivação do direito social à saúde, especificamente na relação entre usuários e operadoras em saúde, mesmo havendo a figura da agência reguladora em nossa legislação. Nossa hipótese, confirmada através da literatura consultada, é que esta interferência fere a harmonia e independência entre os órgãos de poder do Estado e a interdisciplinaridade do tema (âmbito jurídico, político e econômico). A pesquisa valeu-se do método dedutivo, partindo da identificação e interpretação sistemática dos dispositivos constitucionais e legais aplicáveis à matéria. Quanto à tipologia da pesquisa, a abordagem é considerada qualitativa, mediante a observação do fenômeno social denominado “judicialização da saúde suplementar”, sendo que em relação aos objetivos, a pesquisa é exploratória, definindo objetivos e buscando informações sobre o tema estudado; é também descritiva por relatar a natureza e as características dos fatos. Pretende-se contribuir para a discussão sobre a judicialização da saúde, tema que tem sido recorrente em seminários, congressos e encontros de médicos ligados à operadoras de saúde bem como de operadores em Direito. O artigo esclarece que o principal instrumento da regulação estatal no âmbito da saúde é a Agência Nacional de Saúde Suplementar – ANS e demonstrará a relação entre a regulamentação da ANS e o fenômeno da judicialização da saúde suplementar, com o consequente inflação do número de demandas judiciais, a prejuízo de toda a sociedade, segundo uma análise econômica do Direito.

Abstract This paper aims to analyze the interference of the Judiciary in the effectiveness of social right to health, specifically the relationship between users and health operators, even having the figure of the regulatory agency in our legislation. Our hypothesis, confirmed by the literature, is that this interference hurts harmony and independence between bodies of State power and the interdisciplinary subject (legal, political and economic framework). Research drew on deductive method, based on the identification and systematic interpretation of constitutional and legal provisions applicable to material. Regarding the type of research, it is a qualitative approach, and against the goals, it is an exploratory research, setting objectives and seeking information about the research subject. It is also descriptive for reporting the nature and characteristics of the facts. It is intended to contribute to the discussion about the legalization of health, which has been a recurring theme in seminars, conferences and meetings related to medical health operators as well as operators in Law. The article indicates that the main instrument of state regulation in health is the National Supplementary Health Agency (NSHA) and demonstrate the relationship between the regulation of the ANS and the phenomenon of judicialization of health supplement, with the consequent inflation of the number of lawsuits, the detriment of the whole society, according to an economic analysis of law.
