Resumo

Em épocas de garantismo penal, onde tem-se dado precipuamente atenção às garantias e direitos do acusado, a vítima tem sido esquecida no binômio processual penal. Em um breve percurso pelas raízes do surgimento da Vitimologia, e o contexto histórico de onde teve origem, chegar-se-á ao atual estágio do panorama vitimológico. Por meio deste trabalho, buscamos enaltecer a importância do movimento vitimológico e quais as consequências do seu reaparecimento para as construções legislativas voltadas para a evolução do Direito Penal atual. Buscar-se-á traços de políticas e instrumentos vitimológico constante no ordenamento brasileiro, por meio de uma análise minuciosa dos mesmos, procurando analisar influências e sua real efetividade. Entre eles, cita-se Lei Maria da Penha, Lei dos Juizados Especiais, Código de Trânsito Brasileiro e o instituto da Ação Civil Ex Delicto. Será feito um paralelo, ainda, com outros ordenamentos jurídicos, em particular a construção americana sobre a disciplina, destacando os diversos níveis da Vitimologia e sua importância no cenário atual.

Abstract

At times of criminal garanty, which primarily has given attention to the guarantees and rights of the accused, the victim has been overlooked in the procedural-criminal binomial. On a brief journey through history of victimology, and its historical context of where it originated, until the present stage of vitimological panorama. Through this work, we extol the importance of victimologic movement and what the consequences of their reappearance for the parliamentary buildings facing the evolution of the current Criminal Law. Political traits and constant vitimologic instruments in the Brazilian legal system will be studied, trying to analyze influences and their actual effectiveness. Among them, for example Maria da Penha Law, Juizados Especiais Law, Brazilian traffic Code and the Institute of Civil Action Ex delicto. A parallel will be done also with other jurisdictions, particularly the American construction on discipline, highlighting the various levels of Victimology and its importance nowadays.
