Abstract
This research aims to produce more knowledge about the changes that have been taking place in relation to the adoption of children and adolescents by Brazilian homoaffective couples. In order to achieve this objective, the research is classified as a bibliographic review with an exploratory design. Even though there is no specific law governing homoaffective unions in the country, the highest court of the Brazilian Judiciary, the Federal Supreme Court (STF), recently acknowledged that these unions form a family entity and, subsequently, the National Council of Justice (CNJ) disciplined the conversion of the stable union in civil marriage through Resolution No. 175, dated May 14, 2013. Therefore, we can conclude that there is no longer any legal impediment to the adoption of children and/or adolescents by homosexual couples, due to the recognition by the Superior Court of Justice (STJ) of this modality in adoptions. It is clear that what must prevail, always, is the best interest of the child and adolescent as to live in an affectionate and fully protective family environment.
